3. Products & Services

  • All descriptions, prices, promotions, and availability of products are subject to change without notice.

  • We reserve the right to limit quantities or refuse service to anyone at our discretion.

  • We make reasonable efforts to display accurate product information; however, we do not warrant that product descriptions or other content are error-free.

  • Digital products and downloadable content are non-refundable once accessed or downloaded.

4. Orders & Payment

  • By placing an order, you agree to provide accurate, complete, and current billing and shipping information.

  • We reserve the right to refuse or cancel any order suspected of fraud, unauthorized activity, or error in pricing or availability.

  • Payments are processed securely through third-party providers. We are not responsible for errors or breaches that occur with such providers.

5. Shipping & Delivery

  • Shipping times are estimates only and are not guaranteed.

  • Risk of loss and title transfer to you upon our delivery of products to the shipping carrier.

  • We are not responsible for delays, damages, lost packages, or inaccuracies in tracking information once orders are in the carrier’s possession. 

6. Returns & Refunds

Returns, refunds, and exchanges are governed by our Returns & Refund Policy, which is incorporated into these Terms by reference.

7. Intellectual Property Rights

All content on this Site (including text, logos, graphics, images, and software) is the property of Optimistic Attitude or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or exploit our content without prior written consent. Such content is protected by copyright, trademark, trade dress, patent, and other intellectual property and unfair competition laws. 

License to Users: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the site for personal, non-commercial purposes only. This license does not include any resale, republication, distribution, reproduction, modification, or derivative use of the site or its contents. 

Prohibited uses:

You may not:

  • Copy, reproduce, distribute, publicly display, or otherwise exploit any content without prior written permission. 
  • Create derivative works or reverse-engineer any portion of the site or its content. 
  • Use our trademarks, branding, or content in any way that causes confusion or implies association without authorization.
  • Download, scrape, or aggregate content for the purpose of resale, commercial use, or competition.
  • The Optimistic Attitude name, logo, and all original designs are the exclusive property of optimistic attitude. Unauthorized use, reproduction, or sale of these materials is strictly prohibited. 

Infringement & Enforcement: We reserve the right to enforce our intellectual property rights to the fullest extent permitted by law. Any authorized use of our intellectual property may result in legal action, including but not limited to claims for damages, injunctions, and recovery of attorney's fees.

Design & Licensing Notice
Some visual elements, fonts, or templates used in our designs are sourced from licensed third-party platforms (e.g., Canva, Unsplash, Pexels, etc.) under their commercial use rights. All designs are uniquely customized, edited, and arranged by Optimistic Attitude. We respect the intellectual property of all creators and ensure that any third-party materials are used in compliance with applicable licenses.


Trademarks and Branding: The names, logos, slogans, taglines, product names, and other branding associated with Optimistic Attitude are registered and/or unregistered trademarks owned by us. You are not permitted to use our trademarks in connection with any product or service without our prior written consent. 

8. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose.

  • Attempt to gain unauthorized access to our systems.

  • Interfere with the security, functionality, or integrity of the Site.

  • Resell or exploit any portion of the Site without permission.

9. Disclaimer of Warranties

The Site, products, and services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

  • You agree to comply with all applicable local, state, national, and international laws when using the site or purchasing our products. 
  • Our site may contain links to third-party websites or services not owned or controlled by Optimistic Attitude. We are not responsible for the content, privacy policies, or practices of any third-party sites.
  • We are not responsible for delays or failures in performance resulting from acts beyond our reasonable control, including but not limited to natural disasters, labor disputes, internet outages, or government restrictions.

10. Limitation of Liability

To the maximum extent permitted by law, Optimistic Attitude , its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, shipping delays, product misuse, third-party actions, technical errors, product misuse, goodwill, or business opportunities, arising from or related to your use of the Site, products, or services—even if advised of the possibility of such damages. 

11. Indemnification

You agree to indemnify, defend, and hold harmless Optimistic Attitude and its affiliates, officers, directors, employees, and agents from and against all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) resulting from:

  2. Your violation of these Terms;

  3. Your violation of any third-party rights, including intellectual property or privacy rights.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the state of Arkansas, United States of America, without regard to conflict of law principles. You agree that any legal action or proceeding shall be brought exclusively in the courts of Arkansas, United States of America, unless arbitration is required under Section 13.

13. Dispute Resolution & Arbitration

Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, the dispute shall be settled by binding arbitration in accordance to the laws of the State of Arkansas, United States of America, in accordance with the rules of the American Arbitration Association (or relevant arbitration body) 

14. Account Termination Clause

We reserve the right to suspend or terminate any account or access to the Site at our sole discretion, without notice, for any conduct that we believe violates these Terms or is harmful to us or others. 

15. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.

16. Waiver

Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
